Naples FLSA Lawyer
Resolving Southwest Florida Wage and Hour Disputes
Gunterfirm concentrates its practice primarily on employment and labor matters involving Southwest Florida businesses and workers. Attorney Gunter has dedicated his career to matters that affect workers and businesses. More than a decade ago, he became Board Certified as a specialist in Labor and Employment Law by the Florida Bar.
Gunterfirm frequently handles disputes over wage and hour claims. Governed by the Fair Labor Standards Act (FLSA) and Chapter 448 of the Florida Statutes, these cases require meticulous preparation and aggressive representation.
We recognize that a lingering wage dispute can mean delays in receiving much needed income for workers and lost productivity to a business. Therefore, we take decisive steps to move the case forward toward a successful, efficient resolution.
Fair Labor Standards Act
The Fair Labor Standards Act (FLSA) sets standards for minimum wage and overtime pay that apply to most businesses. Most employers must pay their employees at least the federally mandated minimum wage, and pay one-and-one-half times the regular rate for overtime hours worked.
The current federal minimum wage is $7.25 per hour and overtime pay kicks in after 40 hours of work in a work week. However, the statute allows several exceptions. For example, certain salaried employees that meet specific criteria may not be able to recover overtime.
We create cost efficient solutions for businesses who are at risk of having to pay for FLSA violations. These claims become expensive quickly due to the liquidated damages and attorneys’ fees that can be added to the unpaid wages.
Florida Wage and Hour Statute
Chapter 448 of the Florida Statutes codifies labor and wage practices contained in the FLSA. However, Florida has a higher minimum wage of $8.05. The Florida Minimum Wage Act entitles a person who prevails on a wage claim to recover the full amount of unpaid back wages and, oftentimes, liquidated damages and attorneys’ fees and costs.
Pursuing a Claim
Our firm helps affected workers file their claims with the proper court of law. However, the law imposes strict statute of limitations on civil suits, so we recommend seeking counsel as soon as a wage violation is suspected. When an entire staff has been effected by a wage claim, we may also consider filing a class action lawsuit.
