What Is The Americans With Disabilities Act (ADA)?
The Americans with Disabilities Act (or “ADA”) makes it unlawful for employers to discriminate against an individual with a disability.
The truth of the matter is that persons with disabilities often perform their duties at a higher level then other coworkers. Disabled employees can be excellent resources for employers. However, at times, a supervisor allows a bias to get in the way by wrongly perceiving that a person with a disability is going to be a liability, will be unable to do the job, will need to go to the doctor, or worse.
Termination Because Of A Disability
Often, employers will terminate an employee with a disability because the employer believes the employee will be unable to perform the essential functions of the position. Likewise, employers may decline to hire a person with a disability. An employer may not lawfully terminate an employee because of a disability if the employee can perform the essential functions of the job either with or without accommodations.
If you have been fired because of your disability or if you believe an employer may be refusing to hire you based on a disability, or refusing to provide a reasonable accommodation for your disability, call a Fort Myers disability discrimination attorney at 239.334.7017 or email Jason directly at Jason@gunterfirm.com.
What Is A Disability Under The ADA?
The ADA defines disability as a “physical or mental impairment that substantially limits one or more of the major life activities of an individual.” There are numerous examples of what physical or mental impairments may qualify as a disability. If you have any questions regarding whether your impairment is an ADA covered disability, call 239.334.7017 or email Jason at Jason@gunterfirm.com.
What Is A Reasonable Accommodation?
The ADA requires covered employers to make reasonable accommodations for employees with disabilities. Examples of reasonable accommodations include:
- Making Facilities accessible for those with disabilities
- Restructuring job requirements
- Modification of work schedules
- Modification of work equipment or devices
- Other reasonable requests that will allow an employee to perform the essential functions
